TERMS & CONDITIONS

  1. These are the terms and conditions (“Terms and Conditions”) on which OT Group Limited T/A Officeteam (hereinafter called “Officeteam”, “we”, “our” or “us”) supply any of the products listed on our website (officeteam.co.uk) to you. You understand that by ordering any of our products, you agree to be bound by these terms and conditions.    
  2. We may change these terms and conditions at any time, any changes will take effect on the date they are posted on our website.
  3. If you order a product with a minimum age requirement, by ordering you represent that you are of the required age. In any event, if you are an individual, you represent that you are 18 years old or over.
  4. Delivery of products will be next day wherever possible. This delivery is subject to stock and related issues as well other factors outside our control. The time for delivery shall therefore not be of the essence.
  5. You shall pay the reasonable cost of delivery and insurance of the products whilst in transit.
  6. We shall not in any circumstances whatsoever be liable for any incidental or consequential loss expense or damage arising directly or indirectly out of products supplied or by reason of any failure to supply products ordered or by reason of any failure of the products to comply with your order or specification.
  7. We shall not be liable for any failure to fulfil any order, contract or agreement where the failure is due to circumstances beyond our control including (but without limitation to the generality of the foregoing) strikes, lockouts, labour disputes or any kind (whether relating to our own workforce or others) Act of God, war, terrorism, fire, flood, force majeure or any other courses beyond our control.
  8. We reserve the right to sub-contract any order or part thereof.
  9. The property in the products shall not pass to you, whether or not you have taken delivery of the products or any part thereof, until you have paid to us the whole of all sums due to us under the contract or order and we shall be entitled to recover from you any products supplied in respect of which property has not passed to you but without prejudice to our rights under these Terms and Conditions.
  10. All orders for products until accepted or rejected at its discretion by us shall be deemed to be an offer by you to purchase products pursuant to these Conditions and all products are offered subject to availability. We reserve the right at any time to impose a minimum order quantity on any orders for products prior to the order being accepted by us.
  11. Whilst we has attempted to ensure that the information within its price lists, web site and any other publications is correct at the time of publication they do not form part of any contract of sale of goods. For technical reasons colour illustrations should be viewed as a guide only.
  12. Any typography, clerical or other error or omission in any of the sales literature, quotation, price list, web site or any other documentation or information issued by us shall be subject to correction without any liability on the part of us.
  13. All prices are correct at time of going to press and are in pounds sterling and are exclusive of V.A.T.
  14. We reserve the right to, alter, amend or withdraw at any time without notice any of these Terms and Conditions.
  15. The risk in the products passes to you upon delivery.
  16. If any of these terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
  17. The contract shall be governed by the laws of England and the parties submit to the exclusive jurisdiction for the English courts in relation to any dispute hereunder.
  18. Nothing in this agreement shall confer, nor do the parties intend it to confer, any enforceable rights on any third party and the Contracts (Rights on Third parties) 1999 shall not apply.
  19. Promotional offers:

(a)   Any promotional offers that may be running will be subject to availability. We reserve the right to substitute the free gift that may be offered with a product of equal or greater value at our discretion. We reserve the right to not supply the free gift product in cases where we are out of stock of that product. We reserve the right to limit the number of free gift or promotional products per purchase at our discretion.

(b)   If the free gift or promotional product is based on a minimum qualifying spend then this total excludes stamps and collectible products.

(c)   If you return products that qualified for a free gift or promotional product (that is not returned with your product) then we reserve the right to deduct the full retail price of the item from the value of the refund you may be due for the returned product.

(d)   Any promotional offers being offered shall only be open to customers making purchases from the UK mainland.

(e)   Any tax liabilities that may arise as a result of any promotion being run by us will be the responsibility of the beneficiary of such promotion.

(f)    Promotional / Voucher Codes.
Promotional Codes run for a limited period and can be withdrawn early at any time. We only accept one promo / voucher code per order. Voucher codes cannot be used in conjunction with cashback offers. Certain product ranges are excluded from promotional code and cashback offers. Product exceptions are: Postage Stamps; Collectibles; Printers; Laptops; Any items already on promotion (i.e. 3 for 2 Offers) or displayed on the website Clearance Section.  We reserve the right to add further product exceptions at any time. Discounts where valid are applied to the price before VAT and carriage have been added.

CONSUMER ONLY TERMS

  1. All products sold are intended for use by you in a business to consumer relationship. All products sold are intended for use of the person at the point of ordering.
  2. You can cancel your order without giving any reason within 14 days from the day after you receive the products, by informing us in writing (email or post) or by telephone (see Contact Us page). You must also return the product(s) to us immediately, in the same condition in which they were received, and at your own cost and risk.
  3. As a consumer you have a legal obligation to take reasonable care of the products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.
  4. We will refund the price (including delivery charges) within 14 days of the earlier date of when the rejected product is received by us, or from the date evidence of return is received by us, provided always that you have an authorised returns number from us that is clearly visible on the outer packaging not the product packaging and the products remain unopened and are returned in their original packaging and in the condition in which they were delivered otherwise we shall have the sole discretion not to accept the return of products.
  5. Claims arising for shortages or non delivery must be notified within 14 days following receipt of delivery.
  6. Claims arising from delivery of an incorrect product must be notified within 14 days of receipt. We will arrange collection and will replace with the correct products within 5 working days, unless you choose to request a refund of your original order.
  7. Claims arising in respect of defective products should be made in writing within 30 days from the date the product is delivered. Where you have requested a full refund, this will be provided within 5 working days of you returning the defective product at your expense. Where you have requested a replacement, for accepted claims such defective products will be collected and replaced within 5 working days of collection.
  8. Your statutory rights as a consumer are not affected by these provisions.

BUSINESS ONLY TERMS

  1. Claims arising for shortages or non delivery must be notified within 3 working days following receipt of delivery.
  2. Claims arising from delivery of an incorrect product must be notified within 3 working days of receipt. We will arrange collection and will replace with the correct products within 5 working days, unless you choose to request a refund of your original order.
  3. Claims arising in respect of defective products should be made in writing within 3 working days from the date the product is delivered. Where you have requested a replacement, for accepted claims such defective products will be collected and replaced within 5 working days of collection.
  4. We shall not be obliged to fulfil an order to you being a Company or Firm which has passed a resolution, or the Court has made an Order for winding up compulsorily or voluntarily or where a Receiver or Manager has been appointed on behalf of a Creditor or where a Liquidator has been appointed.
  5. In cases where products have been delivered on a pallet, it is your responsibility to dispose of the pallet as you see fit.
  6. Unless provided elsewhere in these Conditions or as provided in section 12 of the Sale of Goods Act 1979 all warranties, conditions and other terms implied by statute, common law, trade custom and industry practice are, to the fullest extent permitted by law, excluded from these Conditions.
  7. If you fail to make payment on the due date then without prejudice to any other right or remedy available to us, we shall be entitled to charge you:
    • Interest (both before and after any judgement) on the amount unpaid at the rate of 3% per month until payment is made (a part month being treated as a full month for the purpose of calculating interest).
    • An administration fee of £30.00.
